analyse2In de Amigoe van 7 februari 2012 werd het IMF-rapport besproken van 2012.
Het IMF komt in zijn voorlopig rapport van april 2013 bijna tot dezelfde conclusies en aanbevelingen als in 2012.

In 1994 meldde de (AVP)regering aan het IMF dat in 2000 het begrotingstekort zou zijn opgeheven.
Dat is nu verschoven naar 2016.
In 2000 bedroeg de schuldquote nog 38% van het Bruto Binnenlands Product (BBP).
De overheidsschuld steeg in 2005 tot 46,1% van het BBP, in 2011 was dat percentage 59.4%.
Het IMF schatte in 2010 dat het begrotingstekort in 2015 op zou lopen tot 65% van het BBP zonder drastische ingrepen.
In 2011 was het percentage al gestegen tot bijna 60% en in 2012 was het 67,5% van het BBP.

IMF 2013
Het eindrapport van het IMF verschijnt in oktober 2013.
Het voorlopig IMF-rapport dateert van 25 april 2013.
Het IMF-concludeert dat Aruba leed onder de wereldwijde economische crisis en de sluiting van Valero.
De overheidsschuld steeg tot 67% van het BBP.
Het toerisme moet verder gediversificeerd worden en de lonen moeten worden afgestemd op de economische groei.
De werkloosheid is hoog (9½ %).
Voor 2013 wordt een economische groei verwacht van ongeveer 2%.
Het IMF is gematigd positief over de genomen maatregelen, maar die leidden tot onvoldoende overheidsinkomsten.
Het IMF acht de halvering van de ingevoerde BBO in 2009 minder gelukkig.
Het IMF geeft aan dat de overheid de begrotingstekorten zal terugbrengen door overheidsondernemingen een hoger dividend te laten betalen.
Ook zal de overheid bezuinigen op de eigen kosten.
* Het (bijna lege) AOV fonds kan het begrotingstekort verder doen oplopen in 2014.
* Het begrotingstekort moet dalen tot 60% van het BBP.
* De kosten van PPP-projecten moeten worden beperkt.
* De AOV moet worden geherstructureerd.
* Indirecte belastingen moeten worden verhoogd, zoals ook in 2010 werd voorgesteld.
* De investeringen voor groene energie leveren een (te) hoog financieringsrisico op.
Die projecten zouden moeten worden gefinancieerd  door Foreign Direct Investments (FDI).
Dit houdt in dat de hoge ontwikkelingskosten niet via PPP-projecten worden gefinancieerd, maar dat buitenlandse bedrijven die projecten zelfstandig opzetten en financieren in Aruba.

De voorgenomen overheidsmaatregelen vermeld in het IMF-rapport van oktober 2010 zijn maar beperkt uitgevoerd en zullen in oktober 2013 ongeveer gelijkluidend zijn als in 2010 (zie Amigoe 7 februari 2012).
Voor wat betreft het terugbrengen van het begrotingstekort en de overheidsschuld zijn de gestelde doelen niet bereikt.
Als voorbeeld moge de volgende voorgenomen overheidsmaatregel dienen die in het IMF-rapport van 2010 stond vermeld.

Verlagen van de staatsschuld met 1% per jaar in de jaren 2012-2014, waarna de staatsschuld op het niveau van 52% van het BBP kan stabiliseren.
De waarnemers van het IMF merken daarbij op dat de Arubaanse regering niet duidelijk heeft gemaakt op welke manier dit doel bereikt wordt.

Waarheid is subjectief
Gezien de algemene termen welke het voorlopig rapport hanteert, kan daar niet uit worden afgeleid dat het IMF verheugd is over de Arubaanse overheidsfinanciën.
Als de vermelde constructiviteit bestaat uit het niet duidelijker aangeven hoe zorgwekkend de stand van de overheidsfinancien zijn, dan is het rapport uitermate constructief.
Als het terugbrengen van de staatsschuld en het begrotingstekort ‘haalbaar’ is, dan willen we allemaal weten hoe dat in de praktijk gaat gebeuren.
De liberale politicus J.R. Thorbecke (1798-1872) zei immers:

“Let niet op onze woorden, maar op onze daden”.

Nu de daadkracht nog.

Eervol of financieel efficiënt?
Is het mogelijk dat de regering de rechtspositie van ambtenaren steeds verder vermindert wegens het stijgende begrotingstekort?
Op 25 april 2013 verscheen in de Diaro een klacht van de douane over het loskoppelingsproces van de Belastingdienst.
Als een overheidsdienst geprivatiseerd of gereorganiseerd wordt, betekent dat vaak dat de dienst zichzelf moet financieren.
Ook raken de daar werkzame ambtenaren nogal eens hun ambtelijke status kwijt, zoals bij de SETAR gebeurde.
Als er een vergelijkbare rechtspositie wordt geboden, is dat geen probleem.
Hoe het veranderingsproces voor de douane moet plaatsvinden, is onduidelijk.
Waarmee Deloitte bezig is, is niet helder.
De rechtspositie voor medewerkers van ondermeer

  • de Universiteit van Aruba,
  • de Sociale Verzekeringsbank,
  • de SETAR en
  • de Centrale Bank

was vóóraf goed geregeld.
Bij een veranderingsproces in een overheidsdienst hoort de overheidsdienst Recurso Humano (voorheen directie Personeel en Organisatie) dit allemaal uit te werken en het veranderingsproces intensief te begeleiden.
Pas als alles geregeld is en de vereiste procedures zijn gevolgd, wordt de overheidsdienst geprivatiseerd, gereorganiseerd en/of losgekoppeld.
Nu lijkt het proces omgekeerd te worden uitgevoerd.
Diensten worden nu geprivatiseerd of gereorganiseerd zonder dat er iets voor de werknemers/ambtenaren is geregeld, denk bijvoorbeeld aan het IASA.

Bedrijf of overheid?
De IMSAN is een publiekrechtelijke organisatie die zich afficheert als een bedrijf en blijkbaar zelfstandig geld wil lenen om de eigen kosten te bestrijden.
Juridisch lijkt dat dubieus.
De dienst zou nog uitgebreid moeten worden met zorg voor diabetici en een afdeling radiotherapie.
Voorzover bekend is daarvoor geen geld opgenomen op de lopende begroting, noch op de begroting voor 2014.
Voor de medewerkers die recent overgingen van Posada (nierdialyse) naar IMSAN is hun rechtspositie nauwelijks geregeld.
De medewerkers van Posada hebben alleen een arbeidscontract, zonder cao, zonder arbeidsreglement, zonder functiewaardering, met pensioenbreuk en een aanzienlijke achteruitgang in hun pensioenvoorziening.
Het enige dat geregeld is bij de overgang voor Posada-medewerkers, is dat de overheidsschalen van toepassing zijn en de minimale aanvullende pensioenregeling.
Het had voor de hand gelegen deze medewerkers op te nemen in het overheidspensioenfonds APFA, maar dat is ongetwijfeld te duur voor de overheid.
Ambtenaren van de directie Volksgezondheid, werkzaam bij IMSAN zouden hun ambtelijke status moeten inleveren, waardoor hun rechtspositie verslechtert.
Daarbij is kennelijk nagelaten het Georganiseerd Overleg bij deze beslissingen te betrekken.
En dat is vereist volgens het ambtenarenrecht.
Laat IMSAN of de af te splitsen dienst Douane dit na, dan handelt werkgever onrechtmatig (hoofdstuk X Landsverordening ambtenarenrecht (LMA).

De vraag rijst hoeveel overheidsdiensten nog meer zelfstandig functioneren zonder de vereiste wettelijke regelingen zoals:

  • functieomschrijvingen,
  • functiewaarderingen,
  • inschaling en/of
  • een cao.

In de zaak GEA 10 augustus 2005, kort geding no. 1840 van 2005, vonnis no. 802, besliste de rechter dat de overheid een overwegende invloed had op het bestuur van de Universiteit van Aruba (UvA) en dat betrokkene ambtenaar was, terwijl betrokkene al jaren geen ambtelijke status meer had en de Landsverordening UvA dit uitsluit.
Een interessante vraag is of nu alle medewerkers van de UvA ambtenaar zijn.
Hun rechtspositie zou daardoor aanzienlijk verbeteren.
De overheid heeft óók op IMSAN een overwegende invloed.
Om toekomstige, ernstige juridische conflicten te vermijden zouden de overheid, vakbonden en de betreffende diensten zich kunnen inzetten om in deze ongewenste situatie verbetering te brengen. Overheidsdiensten die zich slecht behandeld voelen door hun werkgever kunnen meestal niet de kwaliteit, efficiency en gewenste dienstverlening bieden die noodzakelijk is voor een goed functionerende overheid.
Daarnaast is de vraag hoe de overheid toezicht kan houden op ondernemingen als de overheid zelf als werkgever niet de vereiste zorgvuldigheid in acht neemt ten aanzien van de eigen werknemers.
Het Nederlandse Guantánamobaai in wording?
Guantánamo Bay is een marinebasis en tevens een omstreden gevangenenkamp van de Verenigde Staten aan de Guantánamobaai op Cuba.
Nederland past tegenwoordig een steeds inhumanere behandeling van vreemdelingen toe.
Die ontwikkeling geeft reden tot grote ongerustheid en doet de vraag rijzen of Nederland zijn eigen versie van Guantánamo Bay ontwikkelt.

Illegaal verblijf strafbaar Illegaal verblijf wordt strafbaar gesteld in Nederland, vooral om terugkeer te voorkomen.
Dat lijkt al bij voorbaat een illusie, omdat een effectieve sluiting van de grenzen tot heden niet werkte.
Illegaal verblijf is in Aruba en de Nederlandse Antillen jaren lang strafbaar geweest.
Ook dat werkte niet.
De vreemdelingen werden strafrechtelijk aangehouden maar die procedure werd nooit afgemaakt en vervolgens werden de vreemdelingen in strijd met de wettelijke regels soms bestuursrechtelijk verwijderd.
De rechter in Nederland en Aruba heeft regelmatig gezegd dat men niet strafrechtelijk mag aanhouden en bestuursrechtelijk mag verwijderen, maar dat weerhield de overheid niet om het toch te doen.
Bovendien mag niet strafrechtelijk worden aangehouden als er geen sprake is van verdenking van een strafbaar feit.
In Aruba werd dat in 2009 opgelost door de langdurig illegalen te legaliseren.
Vaststaat dat als alle illegalen in Nederland opgespoord, aangehouden en ingesloten moeten worden de politie aan weinig anders meer zou toekomen.
Bovendien zouden alle cellen dan gevuld zijn.
Dat kan niet de bedoeling zijn, tenzij de regering een ongekende bloei van de zware criminaliteit wenst te bevorderen.
Binnen de Partij van de Arbeid (PvdA) heeft deze opstelling recent tot een conflict geleid.
De PvdA wenst geen strafbaarstelling, maar partijleider Samsom heeft dat beloofd in het regeerakkoord en wil zijn belofte houden.
De reden voor deze beslissing is politiek gemotiveerd.
Het kabinet heeft smalle marges.
Bescherming van mensenrechten en een humane behandeling van vreemdelingen heeft in het huidige kabinet geen prioriteit.
Ook de hulp aan illegalen moet strafbaar worden.
Sander Terphuis van de PvdA zegt het volgende over de voorgenomen strafbaarstelling.

‘Deze maatregel pakt geen probleem aan maar mensen. We moeten toe naar een effectiever maar wel humaner terugkeer- en asielbeleid.
Dit maakt juist vreemdelingen zo bang dat zij onderduiken en dan kunnen ze gemakkelijker worden uitgebuit.
Want ze durven toch niet naar de politie te stappen.’

Onlangs overleed een asielzoeker door een aaneenschakeling van fouten van de overheid.
De betrokken bewindspersoon betreurde het, ging door het stof voor de Tweede Kamer en mocht blijven.
Hij nam zijn verantwoordelijkheid voor de tragedie niet.
Al in 2008 werd Nederland gekritiseerd door Amnesty International over de vreemdelingendetentie.
Amnesty vond de vreemdelingenbewaring in strijd met de mensenrechten.

Signaalfunctie
Steven de Winter zegt er in het NRC van 27 april 2013 het volgende over.
Staatssecretaris Teeven (VVD) meent dat als een vreemdeling die de eerste keer illegaal in Nederland wordt aangetroffen, strafrechtelijk kan worden vervolgd, dit een afschrikkende werking heeft.
Deze belangrijke signaalfunctie maakt duidelijk dat onrechtmatig verblijf niet wordt geaccepteerd en wordt beschouwd als een zodanige inbreuk op de openbare orde dat zij met een bestraffing moet worden hersteld.
Onrechtmatig verblijf wordt beschouwd als een inbreuk op de openbare orde.
De openbare orde! Sluit dat niet naadloos aan op artikel 67 lid c van de Vreemdelingenwet 2000? Daar staat immers:

‘Onze Minister kan de vreemdeling ongewenst verklaren indien hij een gevaar vormt voor de openbare orde.’

Zo wordt het pad van overtreding naar misdaad alvast geëffend.
Dit betekent het elastisch toepassen van het recht, waar de moraal plaats gemaakt heeft voor politieke en maatschappelijke hardvochtigheid zonder aanzien des persoons.
Binnen het Koninkrijk kan het beboeten van illegale vreemdelingen het angstwekkend toegenomen begrotingstekort wellicht verminderen.
In dat geval is het nuttig illegaal verblijf officieus te bevorderen.

 

More of the same

In the Amigoe of February 7, 2012, the 2012 IMF-report was discussed. In its preliminary report of April 2013 the IMF comes more or less to the same conclusions and recommendations as in 2012.

In 1994 the (AVP) government reported to the IMF that the budget deficit would be eliminated in 2000. That goal is now tragically postponed to 2016. In 2000, the debt ratio was a ‘mere‘ 38% of the Gross Domestic Product (GDP). Public debt increased in 2005 to 46.1% of the GDP, in 2011 that percentage was 59.4%. Without drastic measures, the IMF estimated in 2010, that the budget deficit in 2015 would rise to 65% of the GDP. In 2011, the percentage had already risen to almost 60%; in 2012 it was 67.5% of GDP.

IMF 2013 The final report of the IMF will be published in October 2013. The preliminary IMF-report was dated April 25, 2013. The IMF concludes that Aruba suffered from the global economic crisis and the closure of Valero refinery. The public debt increased to 67% of the GDP. Tourism should be further diversified and wages should be based on economic growth. Unemployment is high (9 ½%). For 2013, a 2% economic growth is predicted. The IMF is moderately positive about the government financial measures taken, but nonetheless these measures did not generate sufficient government revenues. The IMF considers increasing BBO taxes in 2009, less fortunate. The IMF indicates that the government deficit will decrease because the government will increase the dividends the public enterprises have to pay the government. The government will also cut down on the costs of government. The (almost empty) AOV fund may increase the budget deficit in 2014. The IMF indicates that the government budget deficit should drop to 60% of the GDP. The cost of PPP- projects should be limited. The General Old Age Pension fund must be restructured. Indirect taxes should be increased, as was already proposed in 2010. The investments in green energy present a financial risk which the IMF deems perilous. These projects should be funded by Foreign Direct Investments (FDI). This means that these developments should not be funded through PPP-projects but foreign companies should set up these projects independently and finance these as well in Aruba.

The proposed government measures mentioned in the IMF-report from October 2010 were only partly implemented. The measures the IMF will propose in October 2013 undoubtedly will be approximately identical with these of 2010 (see Amigoe February 7, 2012). Regrettably the 2010 IMF-recommendations reducing the budget deficit and public debt were not implemented. As an example the following proposed government measure that was mentioned in the IMF report of 2010, may serve.

Reducing public debt by 1% per year in the years 2012 to 2014, after which the public debt will stabilize at the level of 52% of GDP. Observers of the IMF remarked that the Aruban government did not clarify how this goal had to be realized.

Truth is subjective Given the general terms in which the preliminary report is drafted, it can not be inferred that the IMF hailed the state of the Aruban government finances. If by its constructiveness is meant that the preliminary report does not express the lamentable state of public finances clearly, then the report is extremely constructive. If the reduction of the national debt and the budget deficit is ‘feasible’, we all want to know how this joyful accomplishment will be practically achieved. The liberal politician J. R. Thorbecke (1798-1872) expressed the idea of executing political promises without fail. He said “Let not our words, but by our actions speak.”Where is the missing vigour to act conclusively?”

Honourable or financially efficient? Is it possible that the government reduces the legal status of civil servants because of the ever-increasing budget deficit? On April 25, 2013 the Diario published a complaint by the Customs Office on the process of being disconnected from the Tax Office. If a government office is privatized or restructured, this often means that the privatized public office must become self-supporting financially. The civil servants working there, often lose their official status, as happened with the SETAR. If a similar legal status is provided, this is no problem. How the restructuring of the Customs Office is to be achieved, is unclear. What Deloitte is doing exactly in this process, is uncertain. The legal status of employees working at the University of Aruba, the Social Insurance Bank, the SETAR and the Central Bank was well arranged beforehand. When a change in a department of the public administration is expected, the government department Recurso Humano (formerly Personnel and Organization) has to work out the details and intensively support the change. Only when everything is decided and the procedures have been followed, the public privatized, restructured and / or disconnected department can be declared alive and in good health. Now it seems the process to be carried out is reversed Services are being privatized or restructured without any proper support or legal status whatsoever for the employees / officials. This happened for instance to the IASA, which was quietly dissolved with little regard for the position of the civil servants.   Private company or government office? The IMSAN is a public organization that presents itself as a private company and apparently wants to borrow money to meet its financial obligations. Legally that seems a dubious ambition. The service is to be expanded with diabetics care and a radiotherapy department. As far as known, the financial support for this expansion was not included in the current budget or the budget for 2014.   Employees who recently were taken over by IMSAN from the Posada clinic (dialysis) discovered that their legal status is barely regulated. These employees only received an employment contract, without a collective bargaining contract, without labour regulations, no job evaluations or salary specifications and no clear old age pension settlement. Altogether their legal status declined significantly.  The only thing that is regulated for the Posada staff by the transition is that the government salary specifications apply and the minimum supplementary pension scheme. It would have been obvious to include these employees in the government pension fund APFA. It seems that probably that was too expensive for the government. Civil servants of the Health Directorate, working at IMSAN would have to surrender their official status, meaning a deterioration of their legal status. Apparently the government failed to involve the Organized Consultation in these decisions. That is required by the law. If IMSAN or Customs reorganize or disconnect from a directorate ,the government has to address this body, if not their decisions can be deemed unlawful (Chapter X Ordinance civil law (LMA).

The question arises how many government services / departments are functioning without the required legal arrangements such as job descriptions, job evaluations, grading and / or a collective agreement. In the case GEA August 10, 2005, summary proceedings No. 1840 of 2005, judgment No. 802, the judge ruled that the government had a controlling influence over the management of the University of Aruba (UvA). The official concerned was deemed a civil servant, although that person did not have an official status as a civil servant for many years. Moreover UvA Ordinance did not allow this status. An interesting question arises. Are all employees of the UvA forthwith government officials? Their status would improve substantially. The government has also a controlling influence on IMSAN. The court could decide all employees working there are civil servants. To avoid serious legal conflicts in the future, it would be sensible if the government, trade unions and the services concerned can bring themselves to improve this undesirable situation. Civil servants who feel badly treated by their employer usually can not offer the quality, efficiency and desired services necessary for a functioning government. Another question is how the government can control and supervise private companies, while the government itself as an employer is not required to observe the basic care in respect to its own employees.

The Dutch Guantánamo Bay in the making? Guantanamo Bay is a naval base and also is a controversial prison camp of the United States at the Guantanamo Bay in Cuba. The Netherlands now apply a more inhumane treatment of illegal foreign nationals. This development is a cause for great concern and raises the question whether the Netherlands is developing its own version of Guantanamo Bay.

Illegal residence a punishable offense Illegal residence will become a punishable offense in the Netherlands, mainly to prevent recurrence. That seems a foregone illusion, because effective closure of the borders seems impossible. Illegal residency has been a punishable offense in Aruba and the Netherlands Antilles for many years, to no avail. The quantity of Illegal aliens continued to rise. The aliens were criminally detained but that procedure was never completed, then the aliens in violation of the laws and regulations were (sometimes) administratively deported. The court in the Netherlands and Aruba often ruled that the police could not arrest an illegal alien on criminal charges, not finish this procedure and deport that alien on administrative charges. However the government continued with these illegal deportations. In 2004 illegal residence was not punishable by law anymore. It did cost too much. Moreover the police can only arrest an illegal alien if that alien is suspected to be illegal. How can illegal residence and being alien be proved without an obligation of each citizen to identify himself? In Aruba the problem was solved in 2009 by legalizing many illegal residents, as happened early in the nineties of the last century. It is clear that if all illegal immigrants detected in Netherlands, are arrested and confined to prison, the police could not do anything else and it would be very expensive too. Such a policy  cannot be right, unless the government wishes to promote serious crime.   Within the Labour Party (PvdA), making illegal residency into a punishable offense has recently led to a conflict between many party members and its leader, Diederik Samsom. The Labour Party did not wish illegal alien residency to become a criminal offense, but party leader Samson has promised that in the coalition agreement and wants to keep his promise. The reason for this decision was politically motivated. The government has narrow margins. Protection of human rights and a civilized treatment of aliens have no priority in the current Dutch government. The aid to illegal immigrants should be punishable by law as well. Sander Terphuis of the Labour party says the following about the proposed criminalization. “This measure solves no problems but attacks people. We need to move towards a more effective but humane return- and asylum policy. These developments actually scare (il)legal aliens so much, that they go underground and then they can be easily exploited, because they do not dare to inform the police.”   Recently an asylum seeker ended his life due to quite a few errors of the government. The minister in question regretted it, bowed and scraped abjectly to the House and was allowed to continue. He was unwilling to accept responsibility for the tragedy. The Netherlands was criticized by Amnesty International before about the treatment of aliens. Already in 2008 Amnesty found the alien detention in violation of human rights.   Signal Function Steven Winter says in the NRC of April 27, 2013 the following. “Secretary Teeven (VVD) believes that if an alien, who for the first time is apprehended illegally in the Netherlands, he can be criminally prosecuted. The Secretary believes prosecution presents a preventive effect. This important signalling function makes it clear that illegal residency is not accepted and is considered such a breach of public order that it should be restored through a criminal prosecution and punishment with a heavy fine. Unlawful residence is considered a breach of public order. Public policy! Does public order and public policy not connect seamlessly with Article 67 paragraph c of the Aliens Act 2000? That article says: “The Minister may declare the alien undesirable if he poses a threat to public order.” Thus the path of transgression to crime is already paved. Elastic application of the law, where compassionate and moral judgments are lacking, lead to political and social callousness indiscriminately. Within the Kingdom the fining of illegal aliens may reduce the alarmingly increased budget deficit, if these aliens could their heavy fines. In that case the government should facilitate illegal residency unofficially. If the alien cannot pay he can be deported at once as het is undesirable alien. So the government considers this a win-win-situation.
